Shared-Kitchen Allergen Disclosure
Discovery Fire and Settlers Creek, collectively referred to as “DF,” prepare, store, cook, transport, and serve food in environments where wheat and gluten, soy, peanuts, tree nuts, dairy, eggs, sesame, fish, shellfish, and other known allergens are routinely present and handled. DF is not an allergen-free or gluten-free facility. Cross-contact may occur during receiving, storage, preparation, cooking, holding, transport, plating, buffet service, guest self-service, or other stages of food service. DF cannot guarantee that any food, beverage, utensil, preparation surface, serving surface, or service area is free from gluten or any other allergen.
Guest Health and Food-Consumption Responsibility
Each guest is solely responsible for evaluating their own medical condition, dietary restrictions, allergies, sensitivities, and tolerance for potential cross-contact, and for deciding whether to consume any DF food or beverage. All food-consumption choices are made by the individual guest at the guest’s own risk. Guests with celiac disease, an anaphylactic allergy, or another severe food allergy or sensitivity should not consume DF food or beverages, including items described as made without gluten, dairy, peanuts, tree nuts, soy, or another allergen. DF does not undertake to monitor individual guests’ food selections, medical conditions, allergies, dietary restrictions, or consumption decisions.
Notice of an Allergy Does Not Transfer Responsibility
Informing DF, Settlers Creek, an event host, or any DF owner, employee, contractor, chef, server, representative, or other personnel of a guest’s allergy, celiac disease, sensitivity, intolerance, or dietary restriction does not transfer responsibility for that guest’s health, safety, or food-consumption decisions to DF. Receipt of such information does not create a duty, warranty, guarantee, special undertaking, fiduciary responsibility, or assumption of risk by DF.
Ingredient and Preparation Information
DF may answer reasonable questions concerning known ingredients, recipes, suppliers, or ordinary preparation methods based upon information reasonably available at the time. Any ingredient or preparation information provided by DF is offered solely as general information. Menu descriptions, product labels, ingredient lists, written communications, verbal statements, or answers provided by DF personnel do not constitute medical or dietary advice; do not bind DF or create a contractual promise; do not guarantee that an ingredient list is complete or unchanged; do not guarantee that an item is free from an allergen or cross-contact; do not establish that an item is safe for any particular guest; and do not constitute an acceptance or assumption of risk by DF. Guests remain solely responsible for determining whether the information provided is sufficient for their own health and consumption decisions.
Special Menu or Food Requests
When specifically requested, DF may agree to prepare or identify certain dishes as made without a specified ingredient, including gluten, dairy, peanuts, tree nuts, soy, or another identified ingredient. Such a request changes only the intended recipe or ingredient selection. It does not make the food allergen-free, eliminate the possibility of cross-contact, establish that the item is safe for a particular guest, or create any warranty or guarantee. DF may decline any special menu, ingredient, preparation, or food-service request that it cannot reasonably accommodate.
Client Acknowledgment and Guest Communication
By signing the Event Agreement, purchasing or accepting a guest ticket, or entering or attending any event held on the Settlers Creek or Discovery Fire property, the Client and each guest acknowledge and accept this disclosure. The Client further agrees to communicate this disclosure to the Client’s guests, invitees, vendors, and other attendees.
Client understands and agrees that:
- DF does not guarantee allergen-free or gluten-free food or service environments;
- Advising DF of a guest allergy or dietary restriction does not transfer responsibility to DF;
- Information provided by DF does not constitute a guarantee of safety or an assumption of risk;
- Each guest remains responsible for their own health, dietary decisions, and food-consumption choices; and IMPORTANT: DF food is not suitable for guests who require a guaranteed allergen-free or gluten-free preparation or service environment.
- Guests requiring a guaranteed allergen-free or gluten-free environment should not consume DF food or beverages.
